These Terms and Conditions ("Terms") govern your use of the Hurdle mobile application, platform, and all related services (together, the "Platform") operated by Hurdle, a UK sole trader business run by Nathaniel McAllister.

Please read these Terms carefully before creating an account. By creating an account and using the Platform you confirm that you are at least 18 years old, that you have read and understood these Terms, and that you agree to be bound by them.
These Terms should be read alongside our Privacy Policy, which explains how we collect and handle your personal data.

2. What the Platform Is
2.1. Hurdle is a career progress platform designed to help individuals navigate professional challenges including job searching, career transitions, redundancy, entrepreneurship, and professional development. The Platform combines a peer community, structured task and progress tools, learning content, events, and AI-powered coaching features.
2.2. Hurdle is a support and guidance platform. It is not a recruitment agency, a job placement service, a regulated careers advisory service, or a professional consultancy of any kind. Use of the Platform does not guarantee employment, career progression, or any specific professional outcome.
2.3. The Platform is intended for adults aged 18 and over. By creating an account, you confirm that you are at least 18 years old. If we become aware that a user is under 18, we will close their account and delete their data promptly.

3. Your Account
3.1 Creating an account - To access the Platform, you must create an account by providing your name, email address, and completing the onboarding process. You must provide accurate and complete information. You must update your information if it changes.
3.2 Account security - You are responsible for keeping your account credentials secure. You must not share your login details with anyone else or allow anyone else to access your account. If you believe your account has been compromised, you must contact us immediately at info@hurdlecommunity.co.uk.
We are not liable for any loss or damage arising from unauthorised access to your account where you have failed to keep your credentials secure.
3.3 One account per person - Each person may hold only one account. Creating multiple accounts to circumvent a suspension or restriction is a breach of these Terms.
3.4 Account accuracy - You must not impersonate another person, create a false identity, or misrepresent your professional background or credentials on the Platform. Hurdle is a community built on trust - accuracy matters to the people you are connecting with.

4. Acceptable Use
4.1. You agree to use the Platform lawfully, honestly, and respectfully. The following conduct is strictly prohibited:
4.1 Prohibited conduct - content
• Posting content that is defamatory, discriminatory, harassing, threatening, abusive, or hateful toward any individual or group.
• Posting content that infringes the intellectual property rights of any third party - including sharing other people's CVs, documents, or materials without their permission.
• Posting false, misleading, or deceptive content about yourself, other users, employers, or any other party.
• Posting personal information about another individual without their consent.
• Posting sexually explicit, violent, or otherwise offensive content.
• Posting content that promotes or facilitates illegal activity.

4.2 Prohibited conduct - platform use
• Using the Platform for commercial solicitation, recruitment advertising, or any commercial purpose without Hurdle's prior written consent.
• Scraping, data mining, or systematically extracting data from the Platform by automated means.
• Attempting to access systems, accounts, or data that do not belong to you.
• Introducing viruses, malicious code, or any other harmful material into the Platform.
• Using the Platform in a way that interferes with other users' ability to use it.
• Circumventing or attempting to circumvent any security, access control, or authentication measure.
• Sharing your account credentials or allowing another person to use your account.

4.3 Prohibited conduct - community
• Bullying, harassing, or targeting another user - including through direct messages, community posts, or connection requests.
• Misusing the AI coaching features to generate content that could harm or deceive others.
• Using the community to conduct personal or business disputes with other users.

5. Community Content and User-Generated Material

5.1 What you can post
The Platform allows you to post text updates, questions, images, and documents including CVs, cover letters, and portfolios in the community feed. You post this content voluntarily and at your own discretion.

5.2 Your responsibility for content you post
You are solely responsible for the content you post on the Platform. By posting content you confirm that:
• You own the content or have the right to share it.
• The content does not infringe the rights of any third party.
• The content does not breach these Terms or any applicable law.
• You have obtained any necessary consents from individuals who appear in or are identifiable from the content.

5.3 Licence you grant to Hurdle - By posting content on the Platform, you grant Hurdle a non-exclusive, royalty-free, worldwide licence to display, store, and distribute that content within the Platform for the purpose of providing the service. This licence ends when you delete the content or close your account.
We do not claim ownership of your content. You retain all intellectual property rights in content you create.
5.4 Content visibility - Content posted in the community feed is visible to all registered users of the Platform. Before posting any document or personal information - including a CV, cover letter, or portfolio - you should consider carefully what personal information it contains and whether you are comfortable with it being visible to all platform users.

5.5 Content moderation - Hurdle reserves the right to remove any content that breaches these Terms or our community standards without notice. We are not obligated to monitor all content, but we will act on reports of content that breaches these Terms.
If your content is removed, you will be notified where reasonably practicable. Repeated breaches may result in account suspension or termination.
5.6 No liability for other users' content - Hurdle is not responsible for content posted by other users. We do not endorse, verify, or guarantee the accuracy of any content posted by users. You interact with other users and rely on their content entirely at your own risk.

6. AI Coaching Features

6.1 The Coach
The Platform includes AI-powered coaching features including interview practice, CV and cover letter review, scenario-based coaching (such as salary negotiation and networking guidance), and a general coaching chat. These features are designed to support your career development and job search preparation.

6.2 What the coach is not
The AI coaching features are guidance and practice tools. They do not constitute:
• Professional careers advice from a qualified careers adviser.
• Legal advice of any kind.
• Recruitment or headhunting services.
• A guarantee of employment, interview success, or any specific career outcome.
• A substitute for your own judgement and professional advice where appropriate.

6.3 Accuracy and limitations - AI-generated content and feedback may contain inaccuracies, errors, or outdated information. The AI coach does not have access to real-time labour market data, specific employer requirements, or your personal circumstances beyond what you share within the Platform.
You should not make significant career decisions - including accepting or rejecting job offers, resigning from employment, or making financial commitments - based solely on AI-generated feedback from the Platform. Always apply your own judgement and seek qualified professional advice where appropriate.

6.4 Content you provide to the AI coach - When you use the AI coaching features you may share personal information including details of your work history, salary expectations, job applications, and career goals. This information is used to generate coaching responses and is handled in accordance with our Privacy Policy.

Do not share sensitive third-party information - such as confidential employer information, personal details of colleagues, or commercially sensitive data - through the AI coaching features.

6.5 AI-generated outputs - You own any content you create using the AI coaching features - for example a cover letter you draft with AI assistance. You are responsible for reviewing and taking ownership of any AI-assisted content before using it externally. Hurdle is not liable for any consequences arising from your use of AI-generated content outside the Platform.

7. Intellectual Property

7.1 Hurdle’s intellectual property
All content, features, branding, design, software, task bank materials, learning content, templates, and other materials provided through the Platform ("Hurdle Content") are owned by or licensed to Hurdle. All rights are reserved.

You may not copy, reproduce, distribute, modify, sell, or exploit any Hurdle Content without our prior written consent. This includes task bank content, coaching frameworks, learning materials, and any other content created or curated by Hurdle.

7.2 Your intellectual property - You retain ownership of all content you create and post on the Platform. The licence you grant to Hurdle is limited to displaying your content within the Platform as described in Section 5.3. We do not claim ownership of your content, and we do not use your content for any purpose beyond delivering the Platform service.

7.3 Reporting infringement - If you believe that content on the Platform infringes your intellectual property rights please contact us at info@hurdlecommunity.co.uk with details of the alleged infringement. We will investigate and take appropriate action.

8. Privacy and Data

8.1. Our Privacy Policy explains in full how we collect, use, store, and protect your personal data in compliance with UK GDPR and the Data Protection Act 2018. It also explains your data rights including access, rectification, erasure, and portability.

8.2. By creating an account you acknowledge that you have read our Privacy Policy. The Privacy Policy is available within the app at all times.

8.3. We will never sell your personal data to third parties. We do not permit advertisers to access your data. We use trusted third-party processors - including Railway, Cloudflare, Firebase, and Resend - under appropriate Data Processing Agreements.

8.4. Your consent to data processing is separate from your agreement to these Terms. You can manage your data consents and exercise your data rights from the settings area of the app at any time.

9. Push Notifications and Communications
9.1. If you allow push notifications on your device, we will send you notifications about platform activity, task reminders, community interactions, and event updates. You can disable push notifications at any time through your device settings.

9.2. We will send you transactional emails - including account confirmation, password resets, and event updates - as part of delivering the service. These are necessary for the service and are not marketing communications.

9.3. Where we wish to send you marketing communications, we will ask for your separate consent. You can withdraw that consent at any time.

10. Third-Party Services and Links
10.1. The Platform may contain links to third-party websites, services, or resources - including employers, events, or resources shared by other users. These links are provided for your convenience only. Hurdle does not endorse, control, or take responsibility for the content, privacy practices, or reliability of any third-party service.

10.2. If you connect your LinkedIn profile or other third-party accounts to the Platform you do so subject to those platforms' own terms and conditions. Hurdle is not responsible for any consequences arising from your use of third-party platforms.

10.3. The Platform is available through the Apple App Store and Google Play Store. Your use of those stores is governed by Apple's and Google's respective terms of service. Hurdle is not responsible for the stores' policies, availability, or decisions regarding the Platform's distribution.

11. Platform Availability and Changes

11.1. We aim to keep the Platform available at all times, but we do not guarantee uninterrupted access. We may need to suspend or restrict access temporarily for maintenance, updates, or technical reasons. We will give reasonable notice of planned maintenance where possible.

11.2. We reserve the right to change, update, add, or remove features from the Platform at any time. Some features may be experimental or in beta and may change or be withdrawn without notice. We will communicate material changes to the Platform to users where reasonably practicable.

11.3. We are not liable for losses or inconvenience caused by planned or unplanned service interruptions, changes to features, or withdrawal of beta features.

12. Access, Membership, and Fees
12.1. Core features of the Platform are currently available free of charge to registered users. We reserve the right to introduce paid features, premium tiers, or subscription plans in the future.

12.2. If we introduce paid features we will provide clear notice of the applicable fees, what is included, and the payment terms before any charge is applied. We will not charge you without your prior agreement.

12.3. Any future payment processing will be carried out by a trusted third-party payment provider. We will not store your payment card details directly.

13. Suspension and Termination
13.1 Termination by you - You may close your account at any time from the account settings within the app or by emailing info@hurdlecommunity.co.uk. On account closure your personal data will be deleted in accordance with our Privacy Policy - within 30 days of account deletion for most data categories.

13.2 Suspension or termination by Hurdle
We reserve the right to suspend or terminate your account immediately and without prior notice if:
• You breach these Terms or our community standards.
• We reasonably believe your account is being used for fraudulent, harmful, or unlawful purposes.
• You provide false or misleading information during registration or on your profile.
• We are required to do so by law or a regulatory authority.

13.3 Consequences of termination - On termination of your account for any reason your right to access the Platform ends immediately. Content you have posted in the community feed will be removed. Your personal data will be handled in accordance with the Privacy Policy. Where termination is due to a breach of these Terms, we reserve the right to prevent you from creating a new account.

13.4 Appeals - If your account is suspended or terminated and you believe this was an error, you may contact us at info@hurdlecommunity.co.uk to request a review. We will consider appeals fairly and respond within a reasonable timeframe. We are not obligated to reinstate accounts where a genuine breach of these Terms has occurred.

14. Disclaimers
14.1. Hurdle is a support and guidance platform. It is not a regulated service of any kind. Nothing on the Platform constitutes professional careers advice, legal advice, financial advice, or psychological counselling.
14.2. We do not endorse, verify, or take responsibility for the accuracy of content posted by other users - including career advice, job opportunities, or professional claims made by community members.
14.3. We do not guarantee that use of the Platform will result in employment, interview success, career progression, or any other specific outcome. Results depend on many factors outside our control.
14.4. AI-generated coaching content is provided for guidance and practice purposes only. It may contain errors or inaccuracies. Do not rely on AI-generated content as a substitute for professional advice.
14.5. The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we exclude all warranties, representations, and conditions - whether express or implied - relating to the Platform's fitness for purpose, accuracy, or reliability.

15. Limitation of Liability

15.1. Nothing in these Terms excludes or limits our liability for:
• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any other liability that cannot be excluded or limited by law.

15.2. Subject to clause 15.1, to the fullest extent permitted by applicable law, Hurdle excludes all liability for:
• Indirect, consequential, or special loss of any kind.
• Loss of earnings, employment, or career opportunity.
• Loss of data or content - other than as required by data protection law.
• Losses arising from your reliance on content posted by other users.
• Losses arising from your reliance on AI-generated coaching content.
• Losses arising from third-party service failures including our processors and the app stores.
• Losses arising from unauthorised access to your account where you have failed to keep your credentials secure.
• Losses arising from interruptions to Platform availability.

15.3. Where liability cannot be excluded, our total liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the greater of £100 or the total amount paid by you to Hurdle in the 12 months preceding the claim.

16. Consumer Rights

16.1. If you are a consumer - that is, an individual using the Platform for personal rather than business purposes - you may have rights under the Consumer Rights Act 2015 and other applicable UK consumer protection legislation that cannot be excluded by these Terms.

16.2. Nothing in these Terms affects your statutory rights as a consumer. If you are unsure of your rights, you can seek advice from Citizens Advice at citizensadvice.org.uk or call 0808 223 1133.

17. Changes to These Terms
17.1. We may update these Terms from time to time as the Platform evolves, as our services change, or as legal requirements change. When we make material changes we will notify you by email and by an in-app notice at least 14 days before the changes take effect.

17.2. If you continue to use the Platform after updated Terms take effect, you are confirming that you have read and agree to the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and close your account.

17.3. The current version of these Terms is always available within the app settings.

18. General
18.1 Entire agreement - These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hurdle in relation to your use of the Platform. They supersede all previous agreements, representations, and understandings.

18.2 Severability - If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

18.3 No waiver
Our failure to enforce any provision of these Terms on any occasion does not constitute a waiver of our right to enforce that provision or any other provision on any future occasion.
18.4 Assignment - You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. We may assign our rights and obligations to a successor business without your consent, provided that your rights under these Terms are not materially affected.

18.5 Force majeure - We are not liable for any failure to perform our obligations under these Terms where that failure results from circumstances beyond our reasonable control - including natural disasters, government action, internet or infrastructure failures, or other events outside our control.

19. Governing Law and Disputes
19.1. These Terms are governed by the laws of England and Wales.

19.2. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19.3. Before commencing any legal proceedings, you agree to contact us at info@hurdlecommunity.co.uk and give us a reasonable opportunity to resolve the dispute informally. We will attempt to resolve all disputes fairly and promptly.

19.4. If you are a consumer, you may also have access to alternative dispute resolution services. Details of approved ADR schemes are available at the Chartered Trading Standards Institute at ctsi.org.uk.
